Overnight, the Senate confirmed President Biden’s 40th judge — the most since Ronald Reagan, who also got 40 judges confirmed in his first year, the Washington Post reports.
Biden’s confirmed judges also far surpass the 18 judges Donald Trump got confirmed in his first year.
Unfortunately, the need to fill vacancies does not promise to provide quicker justice. Although federal judges are appointed for life (pending good behavior), the recent trend is for applicants looking for experience and to gild their resumes, rather than bringing experience to the bar. On the other hand, the main purpose of the federal judiciary is to ride herd on the legislative and executive branch and keep them focused on their duties and obligations. Michael Cohen's argument that Trump and his minions were negligent when his home confinement was revoked and he was sent back to solitary confinement in prison could have widespread reverberations. Holding public servants individually liable for negligent behavior is long overdue. I remember when the issue was first broached in about 1979. Elected officials were warned against arbitrary decisions, especially those that could be seen to benefit themselves.
