Well, it's done. VP Harris cirtified the election of a man who, as an ejudicated insurrectionist, is constitutionally barred from holding any office, military or civil, under the United States. Congress has the oppertunity to uphold their oaths to the Constitution and debar him, but they didn't. In my view that makes each and every one of them, Republican and Democrat alike, complicit in Trump's illegal administration and in whatever crimes he commits.
Glenn Kirschner points out that the Supreme Court's imposition of a totally super-constitutional need for explicit legislation to keep Trump out tied Congress' hands. After all, there is no appeal from the Supreme Court. I donno. He's the lawyer, but it still sticks in my gullet.
It is my understanding that from time to time cases come before the SC that result in overturning an earlier decision, but it is unusual. Another example of legal hanky-panky that sticks in my craw is the recognition of corporate personhood. One very powerful Speaker of the House cited a particular SC decision as authoritative on the matter---- but in fact the SC decision cited said no such thing. Subsequent legislation just accepted the Speaker's falsehood as the legal truth. -----Alan
